ThePhilippinelegalsystem,includingitsjudicialrules,wereadoptedfromandinfluencedmainlybywesterncountries,moreparticularlytheAmericansystem.
Legalissuesandcontroversiesareresolvedprimarilythroughthecourtswhoseprimaryfunctionistosettletherightsofthepartiesandenforcelegalobligations.
Thefilingofcourtactionisthecommonrecourseofpersons,naturalorjuridical,seekingremedytoprotecttheirrightsandenforcelegalobligationsduethem.
However,becauseofthefastgrowingnumberofcasesanddisputesbeingfiledeveryday,theincreasingdocketofpendingcasescompelledtheadoptionofanewmechanismtoresolvecasesinamoreexpeditiousandlesscostlymanner.Theconceptofoutside-the-courtproceedinginresolvingcertaincaseswasthenintroducedinthePhilippinejudicialsystem.Legislationestablishedmechanismsandinstitutionstohelpde-clogcourtcasesandatthesametimegavepartiesanalternativevenuetoadjudicatetheirrightsandinterests.
Theadoptionofvariousmodesofalternativedisputeresolution--suchasarbitration,conciliationandmediation--notonlyexpeditedtheresolutionofcases,butalsoimprovedjudicialeffectivenessandefficiency.Asaresultthereof,theSupremeCourtprioritizedthefollowinggoalswhenenactingrulesofprocedure.(1)disposeoftheexistingbacklogofcasesinallcourts；(2)studyandaddressthecausesoffailuretoobservetheperiodstodecidecasesmandatedbytheConstitution；and(3)promotealternativemodesofdisputeresolution.
